The Occupational Safety and Health Administration (OSHA) created the Whistleblower Protection Program to enforce Section 11(c) of the Occupational Safety and Health (OSH) Act of 1970, which prohibits employers from retaliating against employees who exercise their rights under the OSH Act which include reporting safety or health violations to OSHA and participating in any proceeding related to an OSHA inspection. Since 1983, OSHA has been assigned whistleblower provisions under 16 additional statutes related to the trucking, nuclear power, pipeline, environmental, rail, consumer product safety, and securities industries. OSHA investigates complaints of discriminatory actions taken against employees who blow the whistle under the OSH Act or any of these additional whistleblower statutes.

Military operations in response to terrorism are likely to involve a handful of hostile countries in the Third World where the United States has incontrovertible evidence that agents in the employ of a government have carried out a terrorist attack, that a government has instigated a terrorist attack or permitted one to occur through willful negligence, or that a government is able to bring the perpetrators to justice but refuses to do so. If we apply these criteria to the hundreds of terrorist attacks directed against the United States in the last decade, a military response might have been contemplated in only a handful of episodes--less than one percent: the holding of American hostages in Teheran, but none of the other takeovers of American embassies; if it had come about, the assassination of American officials by hit teams from Libya; the bombings of the American embassy and the American Marine Headquarters in Beirut. Finally, the critics point out, the conflict does not end if and when we strike back. Retaliatory operations may only generate further terrorist attack, requiring further military action. Would this not divert us from whatever original foreign policy goal being pursued.

The U.S. Office of Special Counsel (OSC) is an independent federal investigative and prosecutorial agency. Under the Civil Service Reform Act (CSRA) and the Whistleblower Protection Act (WPA), OSC's primary mission is to safeguard the merit system in federal employment by protecting federal employees and applicants from prohibited personnel practices, especially reprisal for whistleblowing. OSC also has jurisdiction under the Hatch Act to enforce restrictions on political activity by government employees. Finally, OSC facilitates disclosures of wrongdoing in the federal government by operating a secure channel for whistleblowers. Over the last year, in the wake of the tragic events of September 11, 2001, our nation and its leaders have devoted increasing attention to issues of national security and public safety. Federal employees, of course, are on the front lines of these efforts, and are often in the best position to identify security and safety risks. A number of federal workers have come to OSC since September 11, to raise concerns about matters that directly affect national security, and to seek help in addressing what they believe are incidents of retaliation for making disclosures related to the public health, safety and security. Several of those cases are described in this report. In short, in these challenging times, OSC's mission to provide a safe channel for whistleblower disclosures, and to prevent whistleblower retaliation, has become even more important, both to protecting safety and security, and to maintaining public confidence in our governments most vital operations.
