With this in mind，one of the few missing oil and gas jurisdictions of the world,for private participation has been opened. Mexico’s energy market remained as a strategic sector，restricted to any kind of foreign participation and investment.It remained so until the Mexican government reformed its Constitution and congressional laws on December 2013 and August 2014.For the first time in almost 70 years foreign companies will participate in contract or directly in all activities of the energy sector,from upstream todownstream，distribution，storage，petrochemicals and so on. From a purely economical perspective,the Reform was needed to boost a declining oil production and a substantial Technological deficit.Nonetheless,the opposition to the Reform has been fierce.Scholars and political strongholds from citizens to minor parties have opposed to the latest Reform and the most ambitious amendment to Mexico’s Supreme Law.We can recall to at least 13 political,constitutional and legal restraints worthy of reflection.We will revise throughout this work the 5 Constitutional constraints we consider most worthy of analysis and study. Article 27 of Mexico’s Constitution，states that all the Natural Resources on water，air or land，belong to the Nation and should be used for theimprovement and development of its people.We have to understand then,that hydrocarbons do not represent a simple“commoditie”for Mexico;it is a source of growth and prosperity.This contradicts the scheme of the“Risk Contracts”proposed by the executive in its plan to boost the oil reserves production from 2.5 million barrels a day to 3.5 for the next 10 years. In general terms，we will study,5 main issues contradicting the spirit of the Constitution，and most particularly article 27 of the Constitution，while understanding the main changes and the new scheme for Foreign Investment in the energy sector for Mexico.What improvements need to sustain both,a reform that was needed for the rebirth of the energy industry while procuring the spirit of the Constitution. 收起
