The statutory purpose and goals of the Act are defined: to encourage employers and employees in efforts to reduce occ... 展开 A training course module concerning legal aspects of the Occupational Safety and Health Act of 1970 is reviewed. The statutory purpose and goals of the Act are defined: to encourage employers and employees in efforts to reduce occupational safety and health hazards; to provide employers and employees data on rights and responsibilities for healthful working conditions; to apply health standards and create a review and appellate agency; to provide appropriate reporting procedures; and to encourage joint labor and management efforts. The constitutional basis of coverage under the Act, and its jurisdiction are noted. The structure of the Act, its administrative role, and the role of NIOSH are outlined. Procedural aspects of OSHA are presented: notice of contest; petition for abatement; further notice; pleadings, discovery and motions; hearings; post hearing review; and court review. Duties and rights of employers and employees, and the relationship between the Act and civil litigation are discussed. Guidelines are presented for record keeping, reporting, and posting requirements under the Occupational Safety and Health Act. 收起
